    Dear Sharon:

    Earlier this week I emailed you about this Friday's Senate hearing, where whistleblowers such as Bunnatine Greenhouse will be testifying about abuses by government contractors in Iraq. I also asked you to attend the hearing and/or to contact C-Span to request that they cover it, so that the entire country can hear about how defense contractors are bilking U.S. taxpayers and retaliating against honest employees.

    Yesterday, we were informed that the hearing, which is scheduled for 10:30AM in the Dirksen Senate Building, room 226, will now have two panels. The first panel will consist of witnesses testifying about the Blackwater security contracts, and our panel, focusing on Iraq Whistleblowers, will be the second. If you plan to attend, and would only like to hear the whistleblower panel, you should show up around 11:00.

    This is an opinion of the Commissioner of Administration, hereinafter "Commissioner," issued pursuant to Minnesota Statutes, section 13.072 (2001). It is based on the facts and information available to the Commissioner as described below.     Facts and Procedural History:

    On December 21, 2001, IPA received a letter from Jeffrey Kummer, Projects Editor for the Pioneer Press. In his letter, Mr. Kummer asked the Commissioner to issue an opinion regarding the fee the St. Paul Police Department charges for copies of a database of all vehicles towed to the St. Paul Police impound lot from 1996 through March 2001. On January 8, 2002, after consultation with IPA staff, the issue statement was agreed upon. The Commissioner notes that both Mr. Kummer and Chuck Laszewski of the Pioneer Press have been involved in requesting data from the City.

    IPA, on behalf of the Commissioner, wrote to William Finney, Chief of the City's Police Department, in response to Mr. Kummer's request. The purposes of this letter, dated January 8, 2002, were to inform him of Mr. Kummer's request and to ask him to provide information or support for the City's position. On January 18, 2002, IPA received a response, dated same, from Reyne Rofuth, Assistant St. Paul City Attorney.


    A summary of the facts is as follows. In a letter dated May 22, 2001, Mr. Laszewski wrote to the City requesting access to the database containing information about cars towed to the City's impound lot during St. Paul snow emergencies from 1996 through March 2001.


    On September 17, 2001, Michael Jordan, the Police Department's Public Information Coordinator, wrote to Mr. Laszewski. Mr. Jordan wrote:



    ...I now understand you want the data base to include data for all cars towed [from 1996 through March 2001]. You specifically requested data on [sic] car's make, model, license number, tow date, tow location, vehicle identification number and registered owner plus any other information logged in.

    You indicated you could take the data in any number of formats, including DBF files and could take it on floppy disks. We can provide the public data explained below in a D-Based format on floppy disks.

    ...You have also indicated in one of those phone conversations you do not need the narrative data.

    The Department can provide you with all the requested data and the data from the four field screens except data identifying the registered owner, which would include the name and address of the registered owner. The non-registered owner data is public data. It is the position of the Saint Paul Police Department that registered owner data is not public data pursuant to Title 18 USC (United States Code)2721.


    Mr. Jordan then cited Minnesota Statutes, section 13.03, subdivision 3, and stated that the cost for a copy of the database would be $500 plus an additional $100 commercial value add-on fee.


    Mr. Laszewski and Mr. Jordan exchanged additional communications, and Mr. Kummer then requested an opinion.

    Issue:
    In his request for an opinion, Mr. Kummer asked the Commissioner to address the following issue:







    Pursuant to Minnesota Statutes, section 13.03, subdivision 3, clauses (c) and (d), has the City of St. Paul sufficiently justified its charge of $600 for a copy of public data in the database for vehicles towed to the City's impound lot from 1996 through March 2001?

    Discussion:
    When an individual requests copies of data of which s/he is not the subject, pursuant to Minnesota Statutes, section 13.03, subdivision 3(c), the government entity may charge the "actual costs of searching for and retrieving government data, including the cost of employee time, and for making, certifying, compiling, and electronically transmitting the copies." In addition, Minnesota Rules Part 1205.0300, subpart 3, provides that an entity, in determining a fee, shall be guided by the cost of materials, cost of labor, any schedule of standard copying charges, any special costs, and mailing costs.


    In the case of this opinion, the City has asserted that because the database has commercial value, the City may charge a commercial value add-on fee. Pursuant to Minnesota Statutes, section 13.03, subdivision 3(d):



    When a request under this subdivision involves any person's receipt of copies of public government data that has commercial value and is a substantial and discrete portion of or an entire formula, pattern, compilation, program, device, method, technique, process, database, or system developed with a significant expenditure of public funds by the agency, the responsible authority may charge a reasonable fee for the information in addition to the costs of making, certifying, and compiling the copies. Any fee charged must be clearly demonstrated by the agency to relate to the actual development costs of the information. The responsible authority, upon request of any person, shall provide sufficient documentation to explain and justify the fee being charged.

    The City's position is that the actual cost of copying the database is $500 and that the commercial value add-on fee is $100.


    First, the Commissioner will address whether the City's $500 charge for a copy of the database is allowable. As stated above, pursuant to section 13.03, subdivision 3(c), the City may charge the "actual costs of searching for and retrieving government data, including the cost of employee time, and for making, certifying, compiling, and electronically transmitting the copies."


    Section 13.03, subdivision 3(e), specifically discusses data contained in a computer storage medium:



    The responsible authority of [a government entity] that maintains public government data in a computer storage medium shall provide to any person making a request under this section a copy of any public data contained in that medium, in electronic form, if the government entity can reasonably make the copy or have a copy made. This does not require a government entity to provide the data in an electronic format or program that is different from the format or program in which the data are maintained by the government entity. The entity may require the requesting person to pay the actual cost of providing the copy.

    On May 22, 2001, Mr. Laszewski indicated he could take the data in any number of formats, including "fixed-width or delimited text files, Microsoft Access files

    I wish you luck on your case Sharon. I have concluded that Minnesota is truly incapable of coping with the corruption of its own legal system.

    Gentlemen, considering the countless criminal complaints and requests for investigation of an ongoing crime that I have repeatedly filed with your respective offices over the years, you can be of great assistance to the Minnesota legislature as they seek to learn what legislative inadequacies exist in existing law that would render you unable to recognize probable cause of an ongoing crime and conduct an appropriate investigation of that crime. In Minnesota this apparent inadequacy is so extreme that the local sheriff and police chief refuse to even take my criminal complaints for the record, and the Minnesota POST Broad could not find a single violation of professional ethics in their willful dereliction of duty.     I believe my case not only involves violations of federal law and my civil rights to due process and equal protection of the law under mere color of law and constitutes criminal racketeering, but also includes myriad violations of state laws, such as grand theft, interstate fraud, extortion, conspiracy, aiding and abetting, etc. If this matter does not involve any violations of federal or state law or is outside the purview and scope of everyone’s authority and responsibility to address, please inform me what Minnesota does when a county attorney uses his office to cover up the criminal misconduct of his own office.

    Governor Pawlenty, as you contemplate an emergency session of the legislature, allow me to suggest that the apparent inability of the legal system in Minnesota to cope with the corruption of its own legal system constitutes a legislative emergency worthy of a special session. Of course, you can always refer this continuing crime to the Minnesota Bureau of Criminal Apprehension for an independent investigation, as I have previously requested of you countless times. Alternatively, you can also encourage Dakota County Attorney James C. Backstrom to initiate a warrant for my arrest and extradition to Minnesota for immediate and full enforcement of a Minnesota judgment in a Minnesota court of law. I see little reason for a country attorney to take decades to steal on the installment what he could steal in a Minnesota court of law immediately. Thank you.

    Why not before this? He is a personal crony of President Bush, the same reason he got the job in the first place.

    Let us at least take comfort in the fact that he is not on SCOTUS. I personally filed a criminal complaint against Dakota County (MN) Attorney James C. Backstrom with Attorney General Gonzales that he refused to investigate. I then brought the matter to the attention of President Bush and Senator Specter, who was then Chairman of the Senate Judiciary Committee responsible for confirmation of Supreme Court nominees, and simply pointed out that nothing would kill a Supreme Court nomination faster than integrity. This resulted in the absurd nomination of Harriet Miers until she wisely withdrew her nomination. Justice is where you find it.

    Background Information

    Saint Paul real estate developer Jerry Trooien has
    proposed a $1 billion mixed use retail and residential development on the
    West Side across the Mississippi River from downtown. Called The Bridges of
    Saint Paul, the development will be located between Robert and Lafayette
    streets on a 32-acre site that Trooien already owns.
    As proposed the development will include:
    a.. A 250 room Westin hotel.
    b.. A multi-screen AMC movie theatre complex.
    a.. 375,000 square feet of retail space.
    b.. 1,100 housing units.
    c.. 5,500 free parking places.
    d.. 1,500 construction jobs at payroll of $15
    million per month.
    e.. 1,800 full time equivalent jobs after
    construction.
    The Saint Paul Area Chamber of Commerce has
    carefully studied this proposal and enthusiastically endorses it. The
    Chamber believes the project will generate more than $225 million in retail
    sales, create greatly needed new jobs and generate new taxes for the City.
    Given the City's current budget crunch, the Chamber believes the City should
    welcome this opportunity to grow its tax base and bring an exciting increase
    of energy and vitality to Saint Paul's downtown riverfront. But, the City
    Council will vote on the project in mid-September and there may not be
    enough votes to move this project forward.

    It is important to understand what this vote means.
    The vote will be on whether or not to approve a Planned Unit zoning
    designation for the project. This vote only allows Trooien to develop the
    property in accordance with the plan that he has proposed. If he wishes to
    change the plan at some point in the future, he will have to go back to the
    City Council for approval.

    Still, this vote is crucial to the project. Without
    approval of this rezoning request, Trooien is unable to secure final lease
    agreements or make final financing arrangements. This rezoning gives
    Trooien the opportunity to take his proposal into the market place and see
    if there is sufficient market demand to turn his dream into a reality. This
    vote does not, however, commit the City to providing subsidy of any kind to
    the project. That decision will be made at a later date when both Trooien
    and the City have complete information on the financial details of the plan.
