Paying People for the Things We Take
[Arizona Proposition 207]
“The Fifth Amendment’s guarantee that private property shall not be taken for a public use
without just compensation was designed to bar Government from forcing some people alone to
bear public burdens which, in all fairness and justice, should be borne by the public as a whole.”
—Armstrong v. United States
1INTRODUCTION
In November, 2006, Arizona voters overwhelmingly approved the Arizona Property Rights
Protection Act (Proposition 207), a ballot initiative which requires government to compensate
property owners whose rights to use their property are infringed by government edicts. In the
first test case of Proposition 207, Pacific Legal Foundation is defending Flagstaff landowners
Jon Regner, Paul Turner, Bob Richards and Margaret Allen, whose property rights have been
infringed by the City’s “Historic Overlay Ordinance,” enacted in June, 2007.
HOW FLAGSTAFF HAS STIFLED PRIVATE PROPERTY RIGHTS
In the summer of 2006, Flagstaff firefighter Jon Regner bought property in an older neighborhood
of the City. The land includes a 900 square-foot main house and a 700 square-foot house in
the back; Regner planned to live in the front house while renovating it and replace the rear house
with a duplex which he could rent out for additional income
