Paying People for the Things We Take

INTRODUCTION

In November, 2006, Arizona voters overwhelmingly approved the Arizona Property Rights

Protection Act (Proposition 207), a ballot initiative which requires government to compensate

property owners whose rights to use their property are infringed by government edicts. In the

first test case of Proposition 207, Pacific Legal Foundation is defending Flagstaff landowners

Jon Regner, Paul Turner, Bob Richards and Margaret Allen, whose property rights have been

infringed by the City’s “Historic Overlay Ordinance,” enacted in June, 2007.

HOW FLAGSTAFF HAS STIFLED PRIVATE PROPERTY RIGHTS

In the summer of 2006, Flagstaff firefighter Jon Regner bought property in an older neighborhood

of the City. The land includes a 900 square-foot main house and a 700 square-foot house in

the back; Regner planned to live in the front house while renovating it and replace the rear house

with a duplex which he could rent out for additional income
